Tenancy Agreement

What happens if you are managing the property for a property owner on a rent to rent basis?

Does a landlord want to take a deposit as security just in case something does go wrong?

If a landlord takes a deposit from its tenant, there are legal obligation that it must comply with. For example a landlord must within 30 days put the deposit received in a government-approved tenancy deposit scheme (TDP) if it rents it’s property on an assured shorthold tenancy that started after 6 April 2007. It is therefore highly recommended that a landlord has a robust tenancy agreement in place before it allows tenants to move in.

If a landlord already has a tenancy agreement, it is equally important that it is reviewed.

Tenant Evictions

We are specialist tenant eviction solicitors in Beckenham and the City of London.  If you would like to get your property back, before starting the eviction process, check that you have a legitimate reason for evicting your tenant. For example, are there rent arrears or is your tenant failing to comply with their obligations.
Always keep an accurate record of all agreements, documents and communications with your tenant. This should include all rental agreements, all rental payments/arrears and all correspondence with your tenant (including emails, text/whatsapp messages etc).
Tenant Eviction is a legal process that requires knowledge of the law and careful handling. To avoid potential legal pitfalls, it’s highly recommended to consult with a solicitor as soon as possible so that they can guide you through the process and ensure you are complying with the law.
