If you raised your invoice properly, sent it to your customer, tracked, reminded and chased your customer but they still have not yet paid you. Have they given you a reason? If so, what reason have they given? As the year draws to an end, perhaps you could take legal advice as to whether your customers alleged reasons for not paying are valid or whether they are just pulling a fast one!
Before contacting a debt recovery solicitor, below are a few things that you should do: –
Tip 1 – Find your contact
If you signed a contract with your customer find it along with any documents in support for example separate terms of business.
Tip 2 – Find all outstanding invoices
If there are numerous outstanding invoices, gather them all together in date order.
Tip 3 – Gather all correspondence
Pull together all letters and emails with your customer in date order.
If you also communicated with your customer by text message, WhatsApp messages or other social media platforms such as Instagram and Facebook, take a screen shot of everything in date order too.
Tip 4 – Images
If there are any images of the goods provided, gather those too.
If you provided a service, for example you renovated a kitchen, gather photographic evidence of the works undertaken.
Tip 5 – Witnesses
Did you work alongside someone else who could witness what happened?
Next steps
Once you have gather as much evidence as possible, contact your solicitor and schedule a meeting to take advice. During that meeting your solicitor should be able to analyse your evidence and let you know the strength of your potential case, the length of time to pursue it and the potential costs. They should also be able to tell you whether you might be able to obtain insurance to help.
